References in these Terms to “Elvarian Crest Lodge”, “we”, “us” or “our” mean the Website operator identified above, unless the context requires otherwise. “Website” means elvariancrestlodge.com and its pages. “You” means a person who accesses or uses the Website.

2. Acceptance of these Terms

By accessing or using the Website, you agree to use it in accordance with these Terms and applicable law. If you do not agree with these Terms, you should not use the Website. If you use the Website on behalf of a company, organisation or another person, you represent that you are authorised to act for that person in relation to the relevant enquiry or use.

These Terms should be read together with the Privacy Policy, Cookie Policy and Responsible Gaming information published on the Website. If specific booking or service terms are later supplied to you and there is an inconsistency, the more specific terms will govern the relevant booking or service to the extent of that inconsistency.

3. Website purpose and important scope limitations

The Website provides information about a physical hotel and casino resort, including accommodation, dining, facilities, events, arrival information, responsible gaming and contact options. It is designed to help visitors understand the resort and make enquiries.

The Website does not itself provide online gambling. References to casino gaming describe the physical gaming floor and related resort information. The Website also does not currently provide a customer account, online wallet, online payment checkout or automated hotel-booking confirmation system.

Content on the Website is general information and should not be treated as financial, legal, medical or professional advice. Responsible gaming information is provided for awareness and support, but it does not replace assistance from an appropriate qualified service where such assistance is needed.

4. Eligibility and age restrictions

You may browse the general hotel and resort information subject to applicable law. Access to the physical casino and participation in gambling-related activities are restricted to persons who satisfy the applicable legal and venue-entry requirements, including the 18+ restriction stated on the Website.

Nothing on the Website is an invitation to a person who is legally prohibited from gambling or entering a regulated gaming area. 5. Availability helper and reservation enquiries

The home page and rooms page include an availability helper containing fields for check-in date, check-out date, guest count and promo code. This feature is an enquiry aid only. Submitting it sends the selected values to the Website's contact page using an HTTP GET request. It does not, by itself, create a reservation, hold a room, guarantee a rate, apply a discount, take payment or create a contract for accommodation.

A reservation becomes binding only when the resort or its authorised reservation channel confirms the booking and the applicable booking conditions are satisfied. Availability may change between an initial Website enquiry and confirmation. If a displayed room description, stay concept or promotional message is relevant to your decision, you should confirm current availability, inclusions, exclusions, price and conditions directly with the reservations team before committing.

Because the availability helper uses a GET request, submitted values may appear in the browser address bar. You must not enter payment-card details, identity-document numbers, health information or other confidential information in the promo-code field or other availability fields.

6. Contacting the resort and accuracy of enquiries

The Website publishes telephone and email contact details for reservation and guest-service enquiries. When you contact us, you are responsible for providing information that is accurate enough for us to understand and respond to your request. You should promptly correct information that is materially wrong or has changed.

You must not impersonate another person, submit another person's personal information without appropriate authority, send unlawful or abusive communications, or deliberately provide false booking details. If you make an enquiry for other guests, you are responsible for having appropriate authority to provide the information reasonably needed for that enquiry.

Email and telephone communications do not guarantee immediate response. For time-sensitive matters, the contact page recommends telephone contact. Operating hours, response times and staffing may vary.

7. Rates, promotions and displayed offers

Any rate, package, stay idea, promotion or similar content displayed on the Website is subject to availability and the conditions applicable at the time of booking. Promotional codes may have eligibility rules, validity periods, room or date restrictions, minimum-stay requirements, exclusions or limited inventory. Entering a promo code into the availability helper does not establish that the code is valid or that a discount will be applied.

Unless a confirmed booking states otherwise, Website content should not be interpreted as guaranteeing that a particular room type, restaurant setting, event arrangement, facility, gaming area, promotion or service will be available at every time or on every date. You should request current information before travel where a particular feature is important to your stay.

8. Booking, payment and cancellation conditions

Specific booking terms, prices, payment requirements, deposits, cancellation conditions, amendment rules, check-in requirements and no-show consequences are provided through the relevant reservation or confirmation process. Those specific conditions form part of the booking when accepted and are separate from these Website Terms.

The current public Website does not collect payment-card information through an online checkout. If a payment is required for a booking, use only the payment method and instructions supplied through the authorised reservation process. Do not send full payment-card details by ordinary email unless an authorised and appropriate process specifically instructs you to do so.

Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable mandatory law.

9. Physical casino, responsible gaming and venue rules

The casino information on the Website relates to a physical gaming venue. Entry and participation are subject to applicable law, licensing requirements, age restrictions, identification requirements, responsible-gaming measures, opening hours and venue rules in force at the time of the visit.

Your use of the Website is also subject to our Privacy Policy and Cookie Policy. The current Website stores a consent-banner choice and availability-helper state in browser local storage. The Privacy Policy explains the Website's current information-handling functionality in more detail.

You can clear local storage using browser controls, although doing so may reset remembered Website choices. The current Website does not use the availability helper to create an online account, process a payment or provide online gambling.

21. Governing law and jurisdiction

These Terms and Website use are governed by the laws applicable in Queensland, Australia, together with applicable Commonwealth laws of Australia. Subject to any mandatory consumer or jurisdictional rights that apply to you, disputes relating to these Website Terms may be brought before courts with jurisdiction in Queensland.

If mandatory law in another jurisdiction gives you rights that cannot lawfully be displaced by this clause, this clause does not remove those rights.

22. Severability and no waiver

If a provision of these Terms is found to be invalid or unenforceable, it will be interpreted or limited to the minimum extent necessary where lawful, and the remaining provisions will continue to operate.
